The employee stated he could not come to work, when there was no reasonable reason for him not to, and his was a critical role within the business, fulfilling all of the government criteria for being a key worker. The employer had put all measures in place for a safe working environment. He stated he and his wife were shielding as his wife was vulnerable. His wife owned and managed a restaurant.
There was a suspicion that he was involved in running the restaurant business with his wife.
A short surveillance operation was undertaken on the employee and it was found that he was working with his wife at the restaurant, as the restaurant was open for deliveries and collections.
The surveillance showed him during the day going to suppliers, collecting products and provisions and returning them back to the restaurant, and it showed him on an evening doing deliveries for orders from the restaurant. The surveillance also showed his wife at the restaurant managing a team of staff.
Covert video footage was gathered of the movements of the employee and his wife at the restaurant.
All of the time he was claiming to his employer he was unable to come to work as he and his wife were shielding at their home address. Armed with the evidence the employer was able to prove that the employee was falsely absent away from the business and progress the matter through their internal discipline process.
